Professional Experience

• General Business & Commercial Litigation
  • As an advocate and as an ADR professional Robert has participated in hundreds of business and commercial litigation matters, including numerous breach of contract suits, sales and lease transactions, franchise disputes, fraud claims, insurance coverage and labor and employment issues.
• Federal Litigation
  • Robert has handles a significant number of antitrust, bankruptcy, employment discrimination, intellectual property, securities, and tax cases (contact AMP Mediation for examples of these types of cases)
• Health Care
  • Robert represented a variety of healthcare entities, including professional associations, a hospital, medical device manufacturers, a major drug wholesaler and several providers. He has practiced in the areas of generally representing physicians and dentists in purchasing practices and general corporate law, labor and employment matters, physician peer reviews and a wide range of litigation matters. Robert successfully defended two dental associations in an antitrust lawsuit challenging an insurer’s usual, customary and reasonable payment policies.
• Intellectual Property
  • Prosecuted copyright and trademark applications, drafted licensing agreements, and litigated, arbitrated or settled several suits involving trademark infringement, copyright infringement, misappropriation of trade secrets and domain name disputes. In an action before the Federal Circuit, Robert was the principal draftsman of the brief filed in opposition to the appeal by a leading golf ball manufacturer seeking to enjoin a competitor from selling refurbished golf balls bearing the defendant and counterclaimant’s trademarks and allegedly infringing on its patents.
• Real Estate, Land Use & Environmental
  • Effectively acted as in-house counsel for a real estate company in an action for wrongful termination of multiple asset and property management agreements.
  • Pursued an appeal before the Colorado Supreme Court to review a judgment for malicious prosecution and other torts arising from the alleged wrongful recordation of a lis pendens. The judgement was reversed and the matter remanded to the district court for further proceedings.
  • Robert was involved in several major cases involving the liability of potentially responsible parties and their insurance companies under CERCLA, the California Hazardous Waste Control Law, and other environmental laws for the remediation of hazardous waste sites and damages to property owners. These cases include Times Beach (Missouri), Stringfellow Acid Pits and Love Canal (New York)
  • He also filed amici curiae briefs on behalf of three manufacturers challenging city ordinances purporting to regulate or ban automatic water softeners.
